Biography

Laken’s practice encompasses all aspects of intellectual property law, including patents, trademarks, unfair competition, copyrights, and trade secrets. She represents a wide range of clients, including individual inventors and creators, start-up companies, mid-size and multi-national corporations, and universities.

She handles a variety of litigation matters, including patent, trademark, and copyright infringement as well as trade secret protection. Laken has represented clients in inter partes review proceedings and trademark opposition proceedings before the Patent Trial and Appeal Board.

Her notable cases include:

  • Advantageous settlement for defendant local nonprofit corporation in trademark infringement and unfair competition litigation in the Northern District of Georgia.
  • Advantageous settlement for large research university plaintiff in trademark infringement and unfair competition litigation.
  • Advantageous settlement for petitioner major medical device manufacturer in matter spanning several inter partes review proceedings.

 

Laken’s patent prosecution practice focuses on U.S. and foreign design patent protection as well as utility patent prosecution and patentability opinions in the mechanical, textile, and engineering fields. Her trademark practice encompasses trademark searches and clearance and the filing and prosecution of trademark applications. Additionally, she advises clients regarding applications for copyright registrations and related disputes.

Laken received her J.D. from West Virginia University College of Law and her B.S. in Chemical Engineering from West Virginia University. During law school, Laken served as an editor for the West Virginia Law Review, interned at the West Virginia University Office of Technology Transfer, and served in the Entrepreneurship and Innovation Law Clinic. She received CALI Excellence for the Future Awards in Trademark & Unfair Competition, Food & Drug Law, Entrepreneurship and Innovation Law Clinic, and Business Transactions Drafting.
